FreeBike GPS — Mobile Application and Website

By downloading, installing, or using the FreeBike GPS application (“App”) or visiting freebikegps.com (“Website”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App or Website.
The App and Website are operated by Andrzej Tekieli, an individual based in Zeewolde, Netherlands (“we”, “us”, “our”).

FreeBike GPS is a cycling navigation application for Android that provides:
The Free tier includes online routing, map tiles, and address search.
The Premium subscription (9.99 € / year) includes offline maps, offline routing, and offline address databases.
FreeBike GPS does not require you to create an account. No registration, login, or personal profile is needed to use the App.
Premium subscriptions are billed annually at 9.99 € through Google Play. Billing is handled entirely by Google LLC. By subscribing, you also agree to Google Play’s Terms of Service.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
You may cancel your subscription at any time through the Google Play Store. Cancellation takes effect at the end of the current billing period. Refunds are subject to Google Play’s refund policy.
We reserve the right to change the subscription price. We will notify you at least 30 days in advance of any price change. Continued use after the change takes effect constitutes acceptance of the new price.
FreeBike GPS is designed as a privacy-first application. All routes, activity data, and preferences are stored locally on your device and are never transmitted to our servers.
The App uses the following third-party services under certain conditions:

You agree not to:
Offline map data available for download within the App is sourced from OpenStreetMap contributors and is provided under the Open Database License (ODbL). You are free to use, share, and adapt the data under the terms of that licence.
Routing data files (.rd5) are sourced from BRouter and are subject to their respective licences.
The FreeBike GPS name, logo, and application code are the intellectual property of Andrzej Tekieli. All rights reserved.
Content provided through third-party services (map tiles, geocoding results, routing data) remains the property of the respective providers and is subject to their licences.
The App and Website are provided “as is” and “as available” without warranty of any kind, express or implied.
We do not warrant that:
You use the App for navigation at your own risk. Always observe local traffic laws and exercise your own judgement while cycling.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or Website, including but not limited to personal injury, property damage, or data loss.
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
We reserve the right to modify, suspend, or discontinue the App or Website (or any part thereof) at any time with reasonable notice. We will not be liable to you for any modification, suspension, or discontinuation of the service.
We may update these Terms from time to time. We will notify users of material changes by updating the “Last updated” date at the top of this page. For significant changes, we will provide notice within the App or by email if you have provided one.
Continued use of the App or Website after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
If you are a consumer resident in the EU, you may also benefit from mandatory consumer protection provisions of your country of residence.
